Happytiles Privacy Policy
Effective date: October 26, 2026
Framestory US Inc., doing business as Happytiles ("Happytiles," "we," "us," or "our"), operates happytiles.com. This Privacy Policy explains how we collect, use, disclose, and retain personal information when you upload photos, order framed prints, canvas, collages, caption frames or Photo Art, purchase gift cards, request business framing services, interact with our advertisements, or contact us. These activities and our website are referred to as the "Services."
Personal information means information that identifies, relates to, or can reasonably be linked to a person or household. The practices that apply to you depend on how you interact with us, the features you use, and applicable law. Additional notices may apply to particular features, promotions, or processing activities. This Policy does not replace consent where consent is legally required.
Happytiles currently sells and markets its products in the United States.
1 Information we collect
Information you provide. We collect your name, email address, telephone number, billing and delivery addresses, account details where provided, and information you submit through checkout, our contact form, newsletter signup, reviews, or customer support. We collect order details, shopping-cart activity, payment and transaction information, refund requests, and communications about your orders. For business inquiries and orders, this may also include your company name, project requirements, delivery contacts, and documents you submit to support a tax-exemption request. Payment providers process payment credentials; the information we receive depends on the payment method and provider.
Photos and other content. We collect photos, artwork, text, design selections, instructions, and other files you upload or make available, including through connected accounts. This can include associated metadata, such as file format, dimensions, date, and location information embedded in a file, to the extent supplied and processed by the feature you use. Photos and content may contain information about you or other people. Upload only content you are entitled to provide, and give other people any required notices and obtain any necessary permissions.
Information collected automatically. We collect IP addresses, browser and device information, operating system, language, time zone, cookie and other online identifiers, approximate location inferred from an IP address, referring pages, search terms, pages and products viewed, links clicked, time spent, error reports, and interactions with our communications and advertisements. We use cookies, pixels, tags, local storage, logs, and similar technologies for the purposes described below.
Information from other sources. We may receive information from payment and delivery providers, connected photo or social accounts you authorize, advertising and analytics partners, fraud-prevention providers, and people who purchase gifts for you or otherwise arrange Services involving you. Where permitted, we may also obtain business contact information, publicly available information, and marketing information from business partners. The information available through a connected account depends on that service and the permissions you grant.
Combined information and inferences. We may connect information collected through different interactions, sources, browsers, or devices when we have a lawful basis to do so. We may infer product interests and preferences from shopping activity, purchases, and engagement to personalize products, communications, and advertising. A coded, hashed, or pseudonymized identifier may still be personal information.
You can choose not to provide information. However, we may be unable to fulfill an order, respond to a request, or provide a feature without information needed for that purpose. Providing information is generally voluntary unless a legal requirement applies.
2 How we use information
We use personal information for the following purposes, subject to applicable legal requirements and your choices:
- Provide and administer the Services, process payments, produce personalized products, arrange delivery, handle returns, replacements and disputes, maintain order records, and support repeat purchases.
- Process shopping carts and design selections; prepare previews; adapt content to selected formats; and perform cropping, resizing, enhancement, print preparation, quality assurance, and troubleshooting.
- Answer inquiries, provide assistance, send order and account notices, and manage our relationships with customers, suppliers, and business contacts.
- Understand use of the Services, analyze demand and campaign results, test features and offers, improve product quality and operations, and develop products and services.
- Personalize recommendations, content, and offers; send marketing communications; remind you about unfinished purchases; and help you order again.
- Deliver and measure advertisements, match audiences, identify prospective customers with similar interests, and assess advertising performance across channels, subject to required consent and opt-outs.
- Detect and prevent fraud, abuse, unauthorized access, security incidents, and other harmful or unlawful activity; enforce agreements; establish, exercise, or defend legal claims; and protect people, property, and our business.
- Maintain accounting, tax, audit, compliance, and business records; respond to lawful requests; and evaluate or complete business transactions described in Section 5.
- Create aggregated or deidentified information, and carry out other purposes explained when information is collected or subsequently authorized by you.
We may use aggregated or deidentified information for research, analytics, product development, commercial insights, and other lawful business purposes, including sharing it with partners. Where required by law, we maintain and use deidentified information in deidentified form, do not attempt to reidentify it except as legally permitted, and require recipients to comply with applicable restrictions.
3 Photos and personalized products
We and providers working for us may store, reproduce, process, transmit, and review uploaded content as reasonably needed to provide the Services, manufacture and deliver products, assist you, check quality, prevent misuse, and address complaints or claims. Our artists, production partners, and support personnel may access relevant photos, captions, design instructions, and correspondence for these purposes. We may retain designs and photos to support reorders, replacements, customer support, and our relationship with you, subject to Section 7 and applicable deletion rights.
Where permitted by law and your marketing preferences, personalized communications sent to you may include previews of your uploaded photos, saved designs, previous orders, or unfinished shopping carts. For example, we may show your design in a reminder about an incomplete purchase or a reorder offer. Email and messaging providers may process the content to deliver these communications.
For Photo Art orders, we process your uploaded photo, selected art style, optional captions, revision requests, and approval communications so our artists and production providers can prepare and deliver the artwork you order. We use artificial intelligence tools for Photo Art creation, image enhancement, and quality review. These tools may process your uploaded photos and related instructions as part of preparing and checking your personalized products. Relevant technology providers may receive the information needed to perform these functions.
The processing described above forms part of our ordinary order and service workflow. Public promotional use is separate: we do not display your privately uploaded photos on our website, in advertisements, on social media, or in other public promotional materials without your specific consent. This also applies when we obtain permission through a separate influencer or promotional agreement. Our Terms of Service describe the license you grant for producing your order, marketing products to you using your content, internal administration and research, and preserving records for disputes. Those intellectual-property permissions do not replace consent or other requirements that apply to personal information.
If you submit a public review, testimonial, or content for a clearly identified promotional activity, we may display and promote that contribution with the attribution you provide, consistent with the permissions you grant and applicable law. Public content may be copied or shared by others. Our Terms of Service and any separate content release govern the intellectual-property permissions associated with your content; this Policy describes personal-information processing.
4 Cookies advertising and communications
We and our partners use tracking technologies to operate checkout and other features, remember preferences, secure the Services, understand usage, personalize experiences, and deliver and measure advertising. Advertising partners may combine information about interactions with our Services with information from other websites, apps, or services.
We do not sell or exchange customer lists with other businesses for their own marketing. This is separate from the use of service providers and advertising technologies described in this Policy. Subject to required permissions, advertising technologies may disclose online identifiers and information about website interactions to advertising platforms for retargeting and campaign measurement. Such disclosures may constitute a "sale," "sharing," or processing for "targeted advertising" under applicable privacy laws even if no money is exchanged. Section 9 explains how to submit an opt-out request.
We may send promotional communications about Happytiles products, discounts, and framing ideas through email and other channels you authorize or that applicable law permits. Where a communication requires consent, we obtain the required consent. You can opt out of marketing as explained in Section 9.
We may use technology to understand whether a communication was delivered, opened, or clicked, subject to applicable consent requirements. Section 9 explains how to contact us about tracking and advertising choices.
5 When we disclose information
Service providers and contractors. We disclose information to providers supporting hosting, storage, ecommerce, payment processing, printing and manufacturing, shipping, customer support, analytics, marketing delivery, image processing and AI tools, security, fraud prevention, and professional advice. They receive information appropriate to their functions and are subject to contractual restrictions where required by law. A payment provider or other independent business may also process information under its own privacy notice and legal obligations.
Advertising and analytics partners. We disclose the information described in Section 4 to partners that help us reach audiences, measure campaigns, and understand customer behavior, subject to applicable requirements and choices. Depending on the arrangement, these partners may act as service providers or as independent businesses.
Affiliated businesses. We may disclose information to our parent, subsidiaries, or other companies under common control for the purposes described in this Policy, subject to applicable legal limits and any required notices or consent.
At your direction. We may disclose information when you authorize an integration, ask us to send a gift or a business order to another recipient, publish a review, or otherwise direct us to share information.
Business transactions. We may disclose or transfer information in connection with an actual or proposed merger, acquisition, financing, investment, reorganization, sale of a business or assets, insolvency, or similar transaction. Recipients may include prospective counterparties, their advisers, and a successor to our business, subject to appropriate confidentiality protections and applicable law. A transaction does not eliminate applicable restrictions on previously collected information.
Legal and protective purposes. We may disclose information where reasonably necessary and legally permitted to comply with law or legal process; respond to lawful government requests; investigate suspected wrongdoing; enforce agreements; protect rights, safety, and security; or establish, exercise, or defend claims.
Additional uses you authorize. We may disclose information for additional purposes explained to you and authorized where required. Separate permission is required where the law does not permit reliance on this Policy alone.
6 International processing
We and our providers may process and store information in the United States and other countries where we operate or obtain services. Those countries may have different privacy laws, and information may be accessible to courts, law enforcement, or other authorities under their laws.
7 Retention
We retain information for as long as reasonably necessary and proportionate for the purposes described in this Policy, unless a different period is required by law. We consider the type and sensitivity of information, the purpose of processing, your relationship with us, product and service requirements, inactivity, legal obligations, and relevant limitation periods.
Uploaded photos. We retain uploaded customer photos for no longer than 12 months, and usually for less than three months. During that period, photos may be retained as needed for production, quality review, customer support, reorders, or replacements. You may request earlier deletion by contacting support@happytiles.com, subject to applicable legal requirements. Do not rely on the Services as a permanent photo-storage service.
Other information. Contact, account, and preference information is retained as needed to administer the relationship and your choices. Order and transaction records are retained as needed for fulfillment, accounting, taxes, fraud prevention, and legal claims. Usage and advertising information is retained as needed for security, analytics, campaign measurement, and permitted personalization. Support and legal records are retained as needed to resolve issues, document decisions, and meet legal obligations.
Retention of other records may continue after an order is completed or an account is closed where a lawful purpose remains. We delete or deidentify information when retention is no longer justified. We may retain limited records necessary to honor opt-outs, document requests, or meet legal requirements. These general retention purposes do not extend the photo-retention period stated above. This does not override applicable legal requirements or rights to deletion.
8 Security and external services
We maintain administrative, technical, and organizational measures designed to protect personal information. No website, transmission, or storage system can be guaranteed completely secure. Contact us if you believe information associated with your use of the Services has been compromised.
Third-party websites, social networks, payment services, and integrations have their own privacy practices. Review their notices when interacting with them. Their independent processing is governed by their policies and applicable law; this does not remove our responsibilities for processing we control.
9 Your choices and privacy requests
Marketing. Use the unsubscribe link in a marketing email or contact support@happytiles.com to stop email marketing. Follow the opt-out instructions in marketing texts, including replying STOP where supported. You can also contact us to withdraw a marketing permission or request other marketing opt-outs. We may continue necessary transactional or service communications, consistent with law and your communication preferences.
Cookies and advertising. To request an opt-out of the sale or sharing of personal information or processing for targeted advertising, email support@happytiles.com or use our contact form at https://happytiles.com/pages/contact. Please describe the request and provide the email address associated with your orders or communications, if relevant, so we can locate the applicable records. Do not send passwords or payment-card details.
Browser controls may also block or delete cookies, although doing so may affect functionality. Opting out of targeted advertising does not stop all advertising. Email unsubscribe and advertising opt-outs are separate controls. Contact us if you need help submitting a privacy request.
Other rights. Depending on your location and applicable law, you may request confirmation of processing; access to information and disclosures about its sources, purposes, and recipients; correction; deletion; a portable copy; restrictions on sensitive-information processing; and opt-outs of sales, targeted advertising, sharing, or certain profiling. Some laws also provide rights concerning specific recipients or decisions made through automated processing. We respond to rights available under the law that applies to your request.
Submit requests to support@happytiles.com or through https://happytiles.com/pages/contact. We may take reasonable steps to verify your identity or an agent's authority for requests requiring verification. We do not require an account to exercise rights, or require identity verification for sale or sharing opt-outs except as legally permitted. We use request information to administer the request, protect against fraud, and maintain required records.
Rights are subject to statutory exceptions. Where permitted, we may retain information needed to complete a transaction, meet legal obligations, protect security, or defend claims. We respond within applicable legal deadlines and explain any permitted extension or denial. You may appeal a denial where applicable by emailing support@happytiles.com with "Privacy Appeal" in the subject line. Our response will explain further complaint options where required. We do not unlawfully discriminate or retaliate against you for exercising privacy rights.
10 Additional US state disclosures
Where an applicable state privacy law covers our processing, Sections 1, 2, 4, 5, and 7 describe the information categories, sources, purposes, recipients, and retention criteria. The categories may include identifiers; customer-record information; commercial information; internet or network activity; approximate geolocation; visual content; correspondence; and inferences. Photos and communications may incidentally contain sensitive information. A separate feature notice and any required consent address intentional processing of sensitive information beyond legally permitted purposes.
Advertising disclosures described in Section 4 may be sales or sharing under state law. The associated opt-out methods appear in Section 9. We do not knowingly sell or share personal information of individuals under 16. We obtain consent for sensitive-data processing and provide limitations on its use or disclosure where required.
California residents may also contact us about disclosures for third parties' own direct marketing under California's Shine the Light law, where applicable.
11 Children
Children under 13 may not use the Services. Individuals aged 13 through 17 may use the Services only with the prior consent of a parent or legal guardian who accepts our Terms of Service on their behalf. We do not knowingly collect personal information directly from children under 13. If we learn of such collection, we take steps required by applicable law, including deletion where required.
An adult may provide a family photo containing a child to order a personalized product, provided the adult has the rights and permissions needed for that use. This does not authorize unrelated use of a child's information. Contact support@happytiles.com with concerns about a child's information.
12 Changes to this Policy
We may update this Policy to reflect changes in our Services, business, or legal requirements. The effective date identifies the current version. We provide additional notice and obtain consent where required for material changes. Changes do not retroactively authorize materially incompatible uses of previously collected information without the notices, permissions, or other legal steps required by law.
